By accessing or using Postune ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, then you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

What Postune provides

Postune is a career-aware content publishing assistant that helps professionals create LinkedIn posts and other content to build authority in their target roles. Our service includes:

Starter Tier

• URL ingestion and article processing
• AI-powered post generation
• Draft management (50 draft limit)
• Basic content validation

Pro Tier

• All Starter features
• Career profile setup
• AI skill generation (7 skills)
• 8-week content calendar
• Smart slot suggestions
• Weekly email nudges
• Unlimited drafts

User Control & Content Responsibility

Your control over generated content

Postune is a content drafting tool. You maintain complete control and responsibility:

What You Control

• Whether to use AI-generated drafts
• How to edit or modify drafted content
• Whether and where to publish content
• When to publish content

What Postune Does NOT Do

• Automatically post to LinkedIn or social media
• Access your LinkedIn or social media accounts
• Publish content on your behalf
• Monitor what you do with generated content

Your Responsibilities

By using Postune, you explicitly acknowledge and agree that:

Content Review: You are responsible for reviewing all AI-generated content before publishing
Fact-Checking: You must verify accuracy of claims, statistics, and statements
Publishing Decision: You decide whether, when, and where to publish
Liability: You are solely responsible for content you publish
No Warranty: Postune provides drafts "as-is" without guarantees of accuracy
Regeneration Option: You can regenerate unlimited times if unsatisfied
Manual Editing: You can and should edit content to match your voice and verify accuracy

Publishing Mechanism

Postune generates a draft in your account
You review the draft
You click "Copy" to copy to clipboard OR "Share on LinkedIn" to open LinkedIn
You manually paste into LinkedIn (if using copy) OR manually post (if using LinkedIn button)
You retain full control at every step

Indemnification

You agree to indemnify and hold harmless Postune from any claims, damages, or expenses arising from content you publish using our Service, including but not limited to:

Defamation, libel, or slander claims
Copyright or trademark infringement
False or misleading statements
Privacy violations
Any other claims arising from your published content

AI-Generated Content Terms

Important information about AI content generation

Postune uses artificial intelligence (currently OpenAI) to generate content drafts. By using our Service, you acknowledge and agree to the following:

AI Limitations

Accuracy Not Guaranteed: AI-generated content may contain factual errors, inaccuracies, biases, or misinterpretations
No Verification: AI cannot independently verify facts, check sources, or validate claims
Context Limitations: AI may misunderstand article context or nuance
Suggestions Only: All AI-generated content is a suggestion, not verified or endorsed information
No Professional Advice: AI-generated content does not constitute professional, legal, financial, or medical advice

Your Obligations

Review Required: You MUST review all AI-generated content before publishing
Fact-Check: You MUST verify any statistics, claims, quotes, or factual statements
Edit as Needed: You SHOULD edit content to match your personal voice and ensure accuracy
Brand Alignment: You MUST ensure content aligns with your personal or professional brand
Compliance: You MUST ensure published content complies with platform rules (LinkedIn, etc.)

Our AI Provider

• We currently use OpenAI as our AI service provider
• We may change AI providers to improve quality, cost, or performance
• Any provider changes will maintain equivalent or better privacy and quality standards
• We will notify users of significant provider changes

Data Sent to AI Provider

When you generate content, we send our AI provider:

Article summary (created by us, 5-8 sentences)
Article title and URL (as text reference)
Your notes and insights (if provided)
Your career context (role, industry, target skills)

Data NOT Sent to AI Provider

Your email or personal identifiers
Full article text (only our summary)
Your IP address or device information
Your LinkedIn credentials or account information

No Liability for AI Content

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POSTUNE IS NOT LIABLE FOR:

Errors, inaccuracies, or omissions in AI-generated content
Consequences of publishing AI-generated content
Third-party claims arising from AI-generated content you publish
Damages resulting from reliance on AI-generated content

YOU ASSUME ALL RISK ASSOCIATED WITH AI-GENERATED CONTENT.

User Accounts

Account creation and responsibilities

Account Creation

To use Postune, you must create an account by providing a valid email address. You are responsible for maintaining the confidentiality of your account and password.

Account Responsibilities

• Provide accurate and complete information
• Keep your account information up to date
• Maintain the security of your password
• Notify us immediately of any unauthorized use
• Accept responsibility for all activities under your account

Account Termination

You may terminate your account at any time. We may suspend or terminate your account for violation of these Terms or for any other reason at our sole discretion.

• Attempt to reverse engineer or hack the Service

• Share your account credentials with others
• Use automated tools to access the Service

• Unlimited posts during trial period
• Full access to all Pro features
• No credit card required
• Automatically downgrades to Free after 7 days

Starter Tier ($4.90/month)

• 50 posts per month
• 50 draft storage limit
• AI content generation
• Email support

Pro Tier ($14.90/month)

• Unlimited posts
• Unlimited draft storage
• Career profile and themes
• Content calendar
• Weekly nudges
• Priority support

Fair Use Policy

While we offer "unlimited" posts for Pro users, we reserve the right to:

Limit excessive usage that impacts Service performance
Suspend accounts using automated tools or bots
Throttle requests to prevent abuse

Rate Limits

• Maximum 50 URL ingests per 15 minutes
• Maximum 100 API requests per hour
• Designed to prevent abuse, not limit normal use

Account Restrictions

We may restrict or terminate accounts that:

Violate these Terms or our Acceptable Use Policy
Use automated tools to access the Service
Attempt to reverse engineer our Service
Create multiple accounts to circumvent limits
Engage in fraudulent payment activity

Basic features with 50 posts per month

Pro Plan

$14.90/month

Advanced features with unlimited posts

Trial Period

• New users receive a 7-day free trial with Pro features
• Trial includes unlimited post generations
• No credit card required for trial
• After trial, users are automatically downgraded to Free tier (1 post/month)
• Users can upgrade to Starter or Pro anytime

Billing and Payment

• Subscriptions are billed monthly in advance
• Payment is processed through Stripe
• All fees are non-refundable except as required by law
• We may change pricing with 30 days' notice
• Failed payments may result in service suspension

Payment Failures

• Failed payments trigger a 3-day grace period
• We'll attempt to re-charge during grace period
• After grace period, account is downgraded to Free tier
• You can update payment method to restore service

Cancellation and Refunds

• You may cancel your subscription at any time
• Cancellation takes effect at the end of the current billing period
• No refunds for partial months or unused time
• Access to Pro features ends upon cancellation

Intellectual Property

Ownership and usage rights

Postune's Intellectual Property

The Service and its original content, features, and functionality are owned by Postune and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Your Content

You retain ownership of any content you submit to the Service, including articles, notes, and personal information. By using the Service, you grant us a license to process and use your content to provide the Service.

Generated Content Ownership

Your Drafts

• You own all content drafts created using our Service
• You may use, modify, publish, or delete drafts as you wish
• Postune does not claim ownership of your generated drafts

License to Postune

• You grant us a limited license to process your inputs (URL, notes) to generate drafts
• This license ends when you delete your account or specific drafts
• We use your data only to provide the Service, not for other purposes

AI Provider Terms

• Our AI provider (OpenAI) does NOT train models on your data per their API terms
• AI provider may use data for abuse monitoring only
• We have Data Processing Agreements with all providers

Privacy and Data Protection

How we handle your information

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

NON-INFRINGEMENT

AI-SPECIFIC DISCLAIMERS

POSTUNE SPECIFICALLY DISCLAIMS ALL WARRANTIES REGARDING:

Accuracy of AI-generated content
Suitability of AI-generated content for your purposes
Freedom from errors, biases, or inaccuracies in AI content
Compliance of AI-generated content with platform policies
Legal compliance of AI-generated content

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POSTUNE SHALL NOT BE LIABLE FOR:

Indirect Damages: Any indirect, incidental, special, consequential, or punitive damages
Lost Profits: Loss of profits, revenue, data, or goodwill
Service Interruption: Damages from service unavailability or data loss
AI Content: Damages from AI-generated content errors or consequences of publishing
Third-Party Claims: Claims by third parties arising from your use of the Service

MAXIMUM LIABILITY

Our total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

Termination

How the agreement can end

Termination by You

You may terminate your account and stop using the Service at any time. Cancellation of your subscription will take effect at the end of your current billing period.

Termination by Us

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Effect of Termination

• Your right to use the Service will cease immediately
• Your account and data may be deleted
• Provisions that by their nature should survive termination will remain in effect

Governing Law and Disputes

Our Commitment

We do not knowingly collect personal information from children under 16. If you are a parent or guardian and believe your child has provided us with personal information:

We will delete the information within 30 days
We will notify you once deletion is complete

Parental Responsibilities

Parents and guardians are responsible for:

Monitoring their child's use of Postune
Ensuring their child understands the terms of service
Supervising any content their child may generate or publish
Teaching their child about responsible AI content usage

Account Termination

If we discover that a user is under 16, we will immediately terminate their account and delete all associated data in accordance with our privacy policy and applicable laws.
